Recitals and legal information
In its role as publisher, Watts Electronics offers the Watts Vision+ application for remote control of Watts electronic devices.
The application is provided by Watts Electronics SAS registered in the Puy-en-Velay Trade and Companies Register under number 337 605 463 ("Watts Electronics").

Definitions
The following definitions, whether in the singular or plural, are used in these Terms and Conditions of Service:
"Application": means the Watts Vision+ interactive electronic service, the use of which is governed by these Terms and Conditions of Service, which runs on smartphones and compatible hardware and is published by Watts Electronics.
"Data": means any and all information or data of any kind processed, used or generated in connection with the use of the Application.
"Personal Data": means any and all information which, alone or associated with other information, can be used to directly or indirectly designate or identify a specific natural person.
"Intellectual Property Rights": means all literary and artistic property rights (copyright and related rights) and industrial property rights (trademarks, designs and models, patents) governed by the French Intellectual Property Code (Code de la propriété intellectuelle) and international treaties.
"Products": means the connected devices manufactured and/or supplied by Watts Electronics via which the Application collects Data and provides its User Services, with "User" being understood to mean any natural person installing the Application and using it on their smartphone or compatible mobile device.
"Services": means all the features of the Application together with the services offered by Watts Electronics via or in conjunction with the Application.
Article 1 - PURPOSE
This document sets out the Terms and Conditions of Service applicable to the Services. No terms and conditions other than these apply. Notwithstanding the foregoing, these Terms and Conditions of Service are subject to change. The terms and conditions which apply are those appearing in the Application on the date of its installation by the User. All changes shall come into force starting from the date on which they are published in the Application.
To use the Application and the Service, the User must unconditionally accept these Terms and Conditions of Service as well as any new updated version issued by Watts Electronics. As such, the User declares and acknowledges that it has read and understood these Terms and Conditions of Service.
Watts Electronics offers a range of Products that can be remotely controlled, enabling the User to:
- manage the heating system in his-her home(s) remotely;
- check the temperature in real time of the different rooms of his/her home;
- set the heating parameters room by room;
- plan the heating for the home as a whole;
- view the temperature history for each room – for the last 30 days;
- receive notifications and alerts for certain events.
Watts Electronics may also offer a premium version of the Application for a fee, allowing access to additional Services.
The User is informed that the Application functions only in conjunction with Products previously purchased from Watts Electronics – it does not work with any competing systems or products.
These Terms and Conditions of Service exclusively govern the use of the Application by the User and do not apply to the purchase of Products connected to the Application.
The Application can be downloaded free of charge from all mobile application stores and is compatible with smartphones and mobile devices running an IOS or Android operating system.
Each User must create a personal account to access all the Application's Services. Users must be over the age of eighteen to create an account. Each account is strictly personal. To open an account, the User must provide his/her surname, first name, e-mail address and set up the password of his/her choosing. The User must supply accurate information and undertakes to update such information in the event of any changes.
Access to the account following its creation is protected by a username and password known only to the User.
The User is formally prohibited from assigning, lending or transferring his/her login details to any third party or allowing a third party to log on to his/her account by any means whatsoever.
Article 2 - CHANGES TO THE SERVICE AND UPDATES
Watts Electronics reserves the right to make all changes and modifications which might prove necessary or advisable for the provision of the Services.
Watts Electronics offers regular updates to the Application either to correct anomalies or to upgrade the Application to improve its services. These updates are made available via the mobile application stores on which the Application is available. It is recommended that the User download updates as soon as they become available so as to ensure an optimum level of security and guarantee the best possible User experience. Watts Electronics disclaims all liability for any damage, including but not limited to security damage, resulting from any failure by the User to download any available updates.
Watts Electronics reserves the right to suspend access to the Services until the User has downloaded and installed any update which may be necessary for the running and security of the Application.
Article 3 - SERVICE AVAILABILITY AND ASSISTANCE
As a general principle, the Services are accessible to the User 24 hours a day, 7 days a week, all year round. Watts Electronics shall endeavour, under an obligation of means, to provide an annual minimum level of service availability of 99%. Watts Electronics reserves the right to temporarily suspend access to the Application and the Services for maintenance purposes for periods of limited duration (as far as this is possible), after notifying the User thereof beforehand.
It is hereby specified that the Services may be interrupted for reasons external to Watts Electronics, for which Watts Electronics may not be held liable, in particular in the event of a disruption of the Internet network, disruption of services provided by external service providers or disruption of public infrastructures necessary for the use of the Application, and the User expressly acknowledges this.
Watts Electronics provides the User with all information concerning the operation of the Application directly in the Application. Answers to the User's questions can be found directly in the Application and the User’s requests for assistance can be submitted to Watts Electronics directly through the Application.
Article 4 - INTELLECTUAL PROPERTY RIGHTS
4.1 All trademarks, copyrights, database rights and other Intellectual Property Rights of any kind pertaining to the Application, as well as the corresponding source and object code, are the exclusive property of Watts Electronics.
4.2 Watts Electronics hereby grants the User a worldwide, non-exclusive, non-transferable, non-sublicensable license, revocable at any time and free of charge, to use the Application for personal purposes exclusively in accordance with these Terms and Conditions of Service.
4.3 It is prohibited to damage and/or represent, reproduce, alter or use for commercial purposes any element contained in the Application, either in whole or in part, unless authorised to do so, failing which the User shall be liable to prosecution.
4.4 Apart from the rights granted in this Article and without prejudice thereto, the User is not authorised hereunder to:
- sell, rent, sub-license or distribute the Application in any way whatsoever;
- modify the code of the Application and/or merge all or part of such code into other computer programmes;
- compile the code of the Application, decompile it, disassemble it, translate it, copy it, reproduce it, analyse it, reverse engineer it or attempt to do so, except within the limits authorised by law.
Article 5 - RESTRICTIONS ON USE
5.1 The Service is reserved for use by adults or minors who have obtained their parents' permission to use the Application. The Service may only be used by people who have accepted all the terms and conditions of use of their smartphone or compatible hardware, of their operator and of the platform or store where the Application can be downloaded.
5.2 The User agrees to use the Application and the Services only within the scope of the license granted by Watts Electronics and for strictly private use. The User also undertakes, for the entire period of use of the Application, to comply with the laws and regulations in force and not to infringe the rights of third parties or disturb public order. Users are solely responsible for the information they transmit on the Application and Watts Electronics cannot be held liable in any way whatsoever in this respect.
5.3 In the event of a breach by the User of its obligations hereunder, Watts Electronics reserves the right to suspend or terminate access to the Services of the User responsible for the breach, to take all appropriate measures, including, if necessary, deleting the User's account, taking legal action and/or notifying the competent authorities.
Article 6 - ACCESS TO THE SERVICE
Users can authorise the Application, as part of the Premium version of the Application, to use the central unit location data provided by the smartphone or compatible hardware, if they wish to use the Services in their entirety. Article 9 of these Terms and Conditions of Service concerning Personal Data governs the processing of Data collected in this context.
The User is solely responsible for the consequences of any use and any content he/she includes in the Application.
Article 7 - COST OF THE SERVICE
Access to the Application is free of charge, but the User is responsible for all communication and data costs associated with using the Application. Optional additional services may be offered at a charge.
The rates for the Premium version of the Application are given on the application store on which the User downloads the Application and on the Application website.
Article 8 - LIABILITY
8.1 The User acknowledges that he/she is aware of the constraints and limitations of the Internet and mobile Internet.
8.2 It is the responsibility of the User, as the owner of a mobile device, to protect his/her technical equipment against any form of contamination by viruses and/or attempted intrusions. Under no circumstances may Watts Electronics be held liable in the event of any security incident or any malicious cyber activity affecting the User's mobile device. Watts Electronics disclaims all liability in the event of identity fraud following the theft of access codes or any other use of the Application by any third party other than the User.
8.3 Users are solely responsible for the installation, operation and maintenance of the technical equipment and mobile devices required to use the Application. The Application may only be used for devices manufactured by Watts Electronics or other entities of its Group.
8.4 Users are solely responsible for any use of the Service and may not hold Watts Electronics liable for any claims and/or legal proceedings brought against them in respect of the use of the Service. The User shall be held personally liable for any claims and/or legal proceedings brought against Watts Electronics as a result of its use of the Service. In particular, Watts Electronics disclaims any and all liability if Users fail to correctly follow the directions and instructions appearing in this Application and in the event of erroneous input or output Data.
8.5 Watts Electronics disclaims all liability in the event that the Application or the Services provided fail to comply with the laws of a foreign country.
8.6 Links on the Application may lead to other applications, websites or social networks. Watts Electronics disclaims all liability for the content of such other applications, websites or social networks which might infringe the rights of third parties and more generally contravene the statutory provisions in force.
8.7 Watts Electronics disclaims all liability in the event of any malfunction or anomaly of the connected Products with which the Application is operated, and for any damage resulting from any such malfunction. Use of the Application shall in no way be construed as granting any guarantee whatsoever in respect of the Products, in particular as to their proper operation.
8.8 Watts Electronics provides the Application and the Services on an "as is" basis as part of a mere obligation of means, without any guarantee in terms of the operation or availability of the Application and the Services. In this context, Watts Electronics may not be held liable for any errors or lack of suitability in respect of the Data or information contained and generated in the Application.
Article 9 - DATA PROTECTION – Privacy Policy
The Controller of your personal data is Watts Electronics SAS (hereinafter "Watts Electronics”) who complies with the applicable regulations on the protection of Personal Data, in particular French Act No. 78-17 of 6 January 1978 as amended and the European Union's General Data Protection Regulation No. 2016/679 of 27 April 2016 (hereinafter the "Applicable Regulations"). Watts Electronics will collect and process the Personal Data belonging to the Users of the Application for the purposes of providing the Services and enabling the proper operation of the Application, with our contractual relationship constituting the grounds for the aforementioned collection and processing, pursuant to art. 6 par. 1 lett. b) of the GDPR.
Users are not required to provide Watts Electronics with Personal Data, but if they decide not to do so, they shall not be able to use the Application as it requires certain basic Personal Data in order to run.
What information does Watts Electronics collect and how does it use it?
a) Registration in the Application. If the User chooses to use the Application, he/she must create an account and a User profile in the Application. Watts Electronics collects the following necessary Personal Data from the User: surname, first name, email address, home address, language used, and password created by the User.
b) Features of the Products and Connected Services to the Application. The features of the Application collect various types of Personal Data depending on the use made by the User of said features: your postal address, and statistics relating thereto for the Products connected to the Application.
c) Real-time geolocation Data. When using the Premium version of the Application, real-time geolocation Data from the User's smartphone or compatible equipment may be collected to facilitate performance of the Services at the User's location.
d) Saving past Data records in the Application. If the User chooses to use the Application, his/her past Data records shall be saved on the Watts Electronics server when the User selects the specific settings for saving past Data records in the Application.
e) Statistical purposes. Watts Electronics may use Users' Personal Data or any other part of the non-personal Usage Data for statistical purposes, analysing its Users' usage in order to improve the Services and the running of the Application. As part of said processing, the Personal Data shall be pseudonymised or agglomerated to render it anonymous, as appropriate.
f) Marketing. Watts Electronics may share certain Personal Data with trusted service providers to deliver marketing communications, display tailored advertisements, and measure campaign performance. Such providers act on behalf of Watts under strict contractual obligations and data protection safeguards. Where required, Watts will obtain prior consent, which may be withdrawn at any time.
Which is the legal basis of the process of the personal data?
The legal basis for:
- purpose a) is to the performance of a contract to which the data subject is party (art. 6 par. 1 lett b) of GDPR).
- purpose b) is to the performance of a contract to which the data subject is party (art. 6 par. 1 lett b) of GDPR).
- purpose c) is the consent of the data subject (art. 6 par. 1 lett a) of GDPR).
- purpose d) is to the performance of a contract to which the data subject is party (art. 6 par. 1 lett b) of GDPR.
- purpose e) is the legitimate interests pursued by the controller (art. 6 par. 1 lett f) of GDPR).
- purpose f) is the consent of the data subject (art. 6 par. 1 lett a) of GDPR).
For purposes based on contract, data conferral is required due to a contractual relationship. The lack of conferral will prevent the contractual obligation to arise between parties.
For the purposes based on consent, data conferral is optional: in case of non – consent, the data controller won’t be able to process the personal data for the purposes indicated.
For purposes based on legitimate interests, data conferral is necessary to pursue the purpose of the processing.
Which is the data retention of the personal data?
Watts Electronics retain Personal Data for the following periods:
For the purposes of managing the User account: for the period during which the User account is active, plus 3 years on an active basis starting from the last activity. Users are free to deactivate their account at any time. The Data is then archived to enable Watts Electronics to fulfil its statutory obligations for a total retention period not exceeding 10 years.
For the purposes of managing the contractual relationship and the performance of the Services: for the duration of the use of the Services by the User, plus 3 years starting from the last recorded activity. The Data is then archived to enable Watts Electronics to fulfil its statutory obligations for a total retention period not exceeding 10 years. Geolocation Data is retained for a maximum period of 2 months.
For the purposes of conducting statistical studies: Watts Electronics retains Personal Data for the time necessary to achieve the objective of the statistics studies or until objection of the data subject. It should be noted that the Personal Data processed in this context is subjected to pseudonymisation measures.
Does Watts Electronics have technical and organizational measures?
Watts Electronics is committed to ensuring the security and integrity of its Users' Personal Data, as required by art. 32 of the GDPR.
As such, Watts Electronics implements and maintains technical and organisational security measures for the Application that are adapted to the nature of the Personal Data and the risks presented by its processing.
These measures aim to:
- protect Personal Data against destruction, loss, alteration or disclosure to unauthorised third parties,
- ensure that the availability of Personal Data is restored and that it can be accessed within an appropriate timeframe in the event of a physical or technical incident.
How Watts Electronics shares information and international transfers
Watts Electronics manages Personal Data with the utmost care and confidentiality. Personal Data is only made available to Watts Electronics employees, duly authorized to process personal data pursuant art. 29 of GDPR, to third parties acting as Data processors pursuant art. 28 of GDPR, and, where applicable, to independent Data controllers and only to the extent necessary to provide the Services or as permitted by law.
Watts Electronics only shares Users' Personal Data with third parties that Watts Electronics trusts and that present appropriate guarantees. Such third parties include:
- Group companies: Watts Electronics is part of Watts Water Technologies Inc. Watts Electronics shares certain Personal Information with group companies for internal reporting and security purposes and to optimise or provide some or all of its Services;
- Service providers: Watts Electronics shares certain Personal Data with its service providers to the extent that the sharing of such data is relevant, such as, for example, to receive payment, to investigate and prevent fraud, to deliver marketing communications, to display tailored advertisements, to optimise its Services or analyse Data, and/or to enable the hosting of Data and/or all or part of the Services;
- Authorities: Watts Electronics may share User Personal Data with national authorities only to the extent that is required, such as, for example, supervisory authorities, courts and public bodies, and where necessary to comply with a statutory obligation or to enable the prosecution of criminal offences and fraud. Watts Electronics may also provide Personal Data to the authorities to protect its rights and property or the rights and property of third parties;
- Professional Consultants: Watts Electronics shares certain User Personal Information with its professional consultants on a need-to-know basis, such as lawyers, accountants and others.
Watts Electronics may transfer Personal Data outside the territory of the European Union.
In this case, Watts Electronics guarantees that such transfers shall be carried out towards a third country or an international organisation where the Commission has issued an adequacy decision by the European Commission or towards entities providing adequate safeguards with Standard Contractual Clauses (SCC) of the European Commission, pursuant art. 44 and following of GDPR.
In particular, personal data may be transferred to the United States to the parent company of the Watts Water group for statistical purposes.
Personal data will be pseudonymised before the transfer. As the parent company Watts Water does not have the means to re-identify such Data, the latter must be considered, in the context of said transfer, as anonymised Data which are not subject to the Applicable Regulations, as per the case law of the European Union.
IS THERE ANY AUTOMATED PROCESSING?
Personal data will be processed using traditional manual methods, as well as electronic and automated means. It should be noted that no fully automated decision-making processes are carried out.
DATA SUBJECTS’ RIGHTS
Data subjects may assert their rights as expressed in art. 15 and following of GDPR reaching out the Data Controller at: [email protected]
The Data Controller ensures data subjects the possibility to request, at any time, access to their personal data (Article 15), rectification (Article 16), erasure of the same (Article 17), and restriction of processing (Article 18). The Data Controller communicates (Article 19) any rectifications, erasures, or restrictions of processing to each recipient to whom the personal data has been disclosed. The Data Controller informs the data subjects upon their request about such recipients. The Data Controller ensures the right to data portability (Article 20) and, in the event of requests under Article 20, will provide data subjects with the data in a structured, commonly used, and machine-readable format.
Data subjects are entitled the right to object (Article 21) at any time to the processing of data based on legitimate interest or the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller, by writing to the above contacts with the subject 'objection.'
Data subjects have the right to withdraw their consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
If data subjects believe that the processing of personal data by the Data Controller violates any provision of UE Regulation 2016/679, they are free to lodge a complaint with the national supervisory authority, especially in the Member State where they habitually reside or work, or where the violation occurred or to take appropriate legal action.
You may lodge a complaint with your national data protection supervisory authority if you consider it necessary.

Article 10 - COMPLAINTS AND DISPUTES
If you have a complaint, you can contact Watts Electronics by sending an e-mail to [email protected].
In the event of a dispute, you may seek for the matter to be resolved by conventional mediation through one of the existing sectoral mediation bodies or by any other alternative dispute resolution method.
Any dispute arising from the formation, interpretation, validity, performance or termination of the contractual relationship between Watts Electronics and you, as well as any dispute relating to the tortious liability of either party, shall be subject to the rules of jurisdiction under ordinary law.
Article 11 - GOVERNING LAW
These General Terms and Conditions are governed by French law.
